O livro oferece o primeiro estudo sobre o espólio de Edmundo Curvelo (1913-1954), professor da Faculdade de Letras da Universidade de Lisboa e um dos introdutores dos laboratórios psicotécnicos e psicológicos em Portugal. São publicados pela primeira vez manuscritos filosóficos de Curvelo, bem como a sua correspondência com grandes nomes da Cultura e da Filosofia do século XX (W. V. Quine, Alonzo Church, Stephen Kiss, Joaquim de Carvalho e Delfim Santos). O livro apresenta igualmente um estudo do enquadramento da (...) obra de Curvelo e da sua importância para a história do pensamento e da ciência portuguesa do século XX. This book presents the first study into the collection of Edmundo Curvelo (1913-1954), professor in the Faculty of Letters of the University of Lisbon and co-responsible for the introduction of psychotechnic and psychological laboratories into Portugal. Some of his philosophical manuscripts are published here for the first time, along with his correspondence with great names of 20th century Philosophy (W. V. Quine, Alonzo Church, Stephen Kiss, Joaquim de Carvalho and Delfim Santos). I first seriously contemplated writing a book on degree theory in 1976 while I was visiting the University of Illinois at Chicago Circle. There was, at that time, some interest in ann-series book about degree theory, and through the encouragement of Bob Soare, I decided to make a proposal to write such a book. Degree theory had, at that time, matured to the point where the local structure results which had been the mainstay of the earlier papers in the area (...) were finding a steadily increasing number of applications to global degree theory. Michael Yates was the first to realize that the time had come for a systematic study of the interaction between local and global degree theory, and his papers had a considerable influence on the content of this book. During the time that the book was being written and rewritten, there was an explosion in the number of global theorems about the degrees which were proved as applications of local theorems. The global results, in turn, pointed the way to new local theorems which were needed in order to make further progress. I have tried to update the book continuously, in order to be able to present some of the more recent results. It is my hope to introduce the reader to some of the fascinat ing combinatorial methods of Recursion Theory while simultaneously showing how to use these methods to prove some beautiful global theorems about the degrees. The debate surrounding ‘big tech’ and antitrust has dominated public policy discourses over the past few years in many parts of the world. Noteworthy is that several countries and regions, including China, the European Union, and the United States, have launched investigations into the allegedly anticompetitive and exclusionary business practices of companies such as Amazon, Apple, Facebook, and Google and their Chinese counterparts, Alibaba and Tencent. This paper builds on the renewed interest in the topic and discusses in detail – (...) and from an ordoliberal perspective – the key characteristics of the digital economy, the business conduct of tech platforms, and the corresponding antitrust concerns, as well as possible reform steps which could help to strengthen modern-day competition law and policy (and antitrust enforcement). In the light of several ongoing antitrust investigations in the E.U. and the U.S., the following research paper analyzes whether ‘big tech’ – same as the big banks – need special regulatory (and economic -political) attention and if so, how an updated form of regulatory policy for the digital era could look like. It does so by utilizing – and reviving – the normative and business -ethical ideals of German ‘neoliberalism’, also known as (classical) ordoliberalism. Especially, Walter Eucken’s work has (...) the potential to inform and enrich the current debate concerning the regulation of big tech. The main goal of the paper is to outline a potentially new regulatory framework – one that combines (and revises) Eucken’s ordoliberalism with the competition policy of the European Union. (shrink)

The paper presents a renewed Habermasian view on transnational multi-stakeholder initiatives (MSIs) and assesses the institutional characteristics of the Equator Principles Association (EPA) from a deliberative democracy perspective. Habermas’ work has been widely adopted in the academic literature on the political responsibilities of (multinational) corporations (i.e., political corporate social responsibility), and also in assessing the democratic qualities of MSIs. Commentators, however, have noted that Habermas’ approach relies very much on ‘nation-state democracy’ and may not be applicable to democracy in MSIs—in (...) which nation-states are virtually absent. We argue that Habermas’ detailed conceptualization of the institutionalization of deliberative democracy can be applied to transnational MSIs if these initiatives can be said to have their own ‘dèmoi’ that can be represented in associational decision-making. Therefore, we develop a definition of the dèmos of an MSI based on the notion of collective agency. Subsequently, we explain how Habermas’ approach to democracy can be applied to MSIs and show that it has more to offer than hitherto has been uncovered. Our illustrative analysis of the EPA confirms the criticisms regarding this MSI which have recently been articulated by researchers and practitioners, but also yields new findings and possible avenues for the further development of the EPA: That is, although our assessment suggests that the EPA in its current state is still far from being a democratic MSI, the possibility of a sensible analysis of its democratic character indicates that transnational MSIs can, in principle, help to fill governance gaps in a democratic way. Both legal and moral theorists have offered broadly “communicative” theories of criminal and moral responsibility. According to such accounts, we can understand the nature of responsibility by appealing to the idea that responsibility practices are in some fundamental sense expressive, discursive, or communicative. In this essay, I consider a variety of issues in connections with this family of views, including its relationship to free will, the theory of exemptions, and potential alternatives to the communicative model. Focusing on Michael McKenna’s Conversation (...) and Responsibility, I argue that communicative accounts, and the conversational model in particular, direct our attention to important and under-appreciated elements of our responsibility practices. However, rather than focusing on a model of conversation-as-address, as McKenna does, we do better to regard gossip as the paradigmatic conversational form that captures the main features of moral responsibility. Philosophers disagree whether composition as identity entails mereological universalism. Bricker :264–294, 2016) has recently considered an argument which concludes that composition as identity supports universalism. The key step in this argument is the thesis that any objects are identical to some object, which Bricker justifies with the principle of the universality of identity. I will spell out this principle in more detail and argue that it has an unexpected consequence. If the universality of identity holds, then composition as identity not (...) only leads us to universalism, but also leads to the view that there are no mereological atoms. (shrink)

The past few years have seen the opening of several antitrust investigations against some of the most dominant and powerful companies in the world—e.g., the U.S. Department of Justice, numerous states, and the Federal Trade Commission have sued Google, Facebook, and Amazon, and the E.U. has launched additional proceedings against Amazon, Apple, Facebook, and Google. This paper looks at the latest trends and developments in the E.U. and the USA and analyzes the different regulatory approaches taken from a distinct business (...) ethics, that is, ordoliberal perspective. The paper aims to derive ordoliberal-inspired antitrust principles and apply them to the current antitrust proceedings and investigations, thereby assessing their strengths and weaknesses. It also aims at developing ordoliberal-inspired reform proposals which might help to strengthen and “harden” modern-day antitrust regimes. (shrink)

The E.U. is shortly before implementing the Digital Markets Act (DMA), which aims to regulate digital markets and (ideally) rein in the power of big tech gatekeepers. Several researchers claim that this proposal – and especially its goal to ensure the contestability and fairness of digital markets – is ordoliberal in nature, yet what is missing in the academic literature is a closer look at the parallels (and differences) between the E.U.’s competition policy (and the DMA) and ordoliberalism. This paper (...) tries to close the gap and help answer the question of whether the DMA is indeed standing in an ordoliberal tradition. Furthermore, it evaluates the Act’s institutional strengths and weaknesses – as seen from an ordoliberal perspective – and points out potential ways to strengthen E.U. competition policy (and the DMA) and bring it closer to the ordoliberal ideal. Composition as Identity is the view that an object is identical to its parts taken collectively. I elaborate and defend a theory based on this idea: composition is a kind of identity. Since this claim is best presented within a plural logic, I develop a formal system of plural logic. The principles of this system differ from the standard views on plural logic because one of my central claims is that identity is a relation which comes in a variety of (...) forms and only one of them obeys substitution unrestrictedly. I justify this departure from orthodoxy by showing some problems which result from attempts to avoid inconsistencies within plural logic by means of postulating other non-singular terms besides plural terms. Thereby, some of the main criticisms raised against Composition as Identity can be addressed. Further, I argue that the way objects are arranged is relevant with respect to the question which object they compose, i.e. to which object they are identical to. This helps to meet a second group of arguments against Composition as Identity. These arguments aim to show that identifying composite objects on the basis of the identity of their parts entails, contrary to our common sense view, that rearranging the parts of a composite object does not leave us with a different object. Moreover, it allows us to carve out the intensional aspects of Composition as Identity and to defend mereological universalism, the claim that any objects compose some object. Much of the pressure put on the latter view can be avoided by distinguishing the question whether some objects compose an object from the question what object they compose. Eventually, I conclude that Composition as Identity is a coherent and plausible position, as long as we take identity to be a more complex relation than commonly assumed. (shrink)

Hume argued that inductive inferences do not have rational justification. My aim is to reject Hume’s argument. The discussion is partly motivated by an analogy with Carroll’s Paradox, which concerns deductive inferences. A first radically externalist reply to Hume (defended by Dauer and Van Cleve) is that justified inductive inferences do not require the subject to know that nature is uniform, though the uniformity of nature is a necessary condition for having the justification. But then the subject does not have (...) reasons for believing what she believes. I defend a moderate externalist account that seeks to partly accommodate that objection to the radical externalist proposal. It is based on an extension of Peacocke’s theory of concepts: possession conditions for predicative concepts standing for natural properties include (fallible) dispositions to project them to new cases in accordance with inductive inferential patterns. In the present contribution, we argue that all health care professionals and particularly psychotherapists should provide a plausible rationale for their treatment including an etiological model and a model of unique and common change mechanisms. The provision of a plausible rationale has two goals: (1) meet the ethical challenge of informed consent, and (2) to improve treatment outcome by fostering the meaning response. In the course of the ethical and a legal obligation of psychotherapists to obtain patients’ informed consent before (...) initiating psychotherapy, patients have the right to receive maximally comprehensive information for providing their consent, which - among other information about the treatment (such as general psychotherapeutic approach, setting, and procedures) – should include a plausible treatment rationale. A useful concept in conceptualizing and communicating a treatment rationale as part of the informed consent procedure is Moerman’s general notion of the meaning response as the physiological or psychological effects of meaning in the course and treatment of an illness. The more compelling the rational explanation of the targeted treatment effects, the stronger the meaning response is expected to be. As the mechanisms of change in psychotherapy are known to be quite abstract and considered common to all approaches to a large extent, it seems especially important to provide a convincing treatment rationale to strengthen trust in the therapist and potentially foster positive expectations of process and outcome. To that extent, strengthening a patient`s meaning response to information provided at the beginning of psychotherapy may be central to activating common therapeutic factors. (shrink)

Trata-se de uma introdução interpretativa ao primeiro livro filosófico publicado por Simone de Beauvoir, Pirro e Cinéias (1944), que inaugura, segundo ela, após a eclosão da Segunda Guerra Mundial, o período moral de sua carreira literária e seu interesse particular em atribuir um conteúdo material à moral existencialista – junto de um livro publicado posteriormente, Por uma moral da ambiguidade (1947). Destaca-se, portanto, que Beauvoir é a autora que vai superar as oposições que separavam a natureza da cultura, o corpo (...) do espírito, a liberdade da facticidade, a subjetividade da objetividade, o individual do coletivo, o particular do universal, de tal forma que sua alternativa será, no ensaio aqui estudado, pensar como as liberdades separadas entre si se reconhecem mutuamente para que o movimento ontológico de uma em direção à outra possibilite uma investigação do vínculo fundamental e indissociável entre os extremos mencionados. Com efeito, nossa conclusão é que Pirro e Cinéias anuncia duas das ideias centrais que esclarecem o período moral da literatura beauvoiriana, que é a individualidade de cada situação vivida, tal como as situações de suas personagens literárias, e o movimento das liberdades situadas em sua própria dimensão: a dimensão humana. A common view about Moore’s Proof of an External World is that the argument fails because anyone who had doubts about its conclusion could not use the argument to rationally overcome those doubts. I agree that Moore’s Proof is—in that sense—dialectically ineffective at convincing an opponent or a doubter, but I defend that the argument (even when individuated taking into consideration the purpose of Moore’s arguing and, consequently, the preferred addressee of the Proof) does not fail. The key to my (...) defence is to conceive the Proof as addressed to subjects with a different epistemic condition. To sustain this view I formulate some hypothesis about the common general purpose of arguing and I defend that it can be fulfilled even when the addressee of an argument is not someone who disbelieves or doubts its conclusion. In this work we provide a new topological representation for implication algebras in such a way that its one-point compactification is the topological space given in [1]. Some applications are given thereof.

Our democracies presently face a set of unique challenges. In this article we argue that the current crisis needs to be understood as resulting from the convergence of two historical transformations: the paradigm of boundlessness; and what we term “endividualismo”, a novel mutation of individualism in the context of the financial age. The result is a novel political reality where individual rights are ever-expanding and the opportunities for collective action have shrunk to the point of impossibility. The resulting powerlessness of (...) the polity demands new answers: we need to reconfigure the relationship between citizens and political power. (shrink)

En este trabajo se trata de contestar a la cuestión de cómo evaluar los argumentos judiciales de carácter justificativo. Se precisa para ello el sentido de la tesis de la única respuesta correcta; se identifican diversos criterios de corrección y se presta una atención particular a los criterios de universalidad, coherencia, adecuación de las consecuencias, moralidad social y crítica, y razonabilidad. This article deals with the question of how to evaluate justificatory judicial reasoning. To this end, the author clarifies the (...) meaning of the one-right-answer thesis, identifies a variety of criteria of correctness, and gives special attention to the ideas of universality, coherence, (good) consequences, social and critical morality, and reasonability. Interest in spirituality as a protective factor in various aspects of daily life has increased over the years. Still there has been relatively little research attention paid to the effect of spirituality in the workplace. The current study was conducted to explore the role of spiritual well-being as positive spillover effect on job satisfaction when adverse workplace experiences are reported. Spiritual well-being was related to job satisfaction even when the adverse workplace conditions of job frustration, work tension and victimization were (...) present. The context of the findings with other research and theory are discussed, as are directions for future research. (shrink)

En este artículo discuto y rechazo dos argumentos que pretenderían contrarrestar tales juicios, y que conciben erróneamente la relación entre la semántica de mundos posibles y nuestros lenguajes naturales modales. El argumento más importante asume que el dominio de todas las entidades es idéntico al dominio de @. In this paper I discuss and reject two arguments against such judgments, both of which conceive wrongly the relation between possible worlds semantics and modal natural languages. The article is guided by two main research questions: First, do the Equator Principles (EPs), a voluntary CSR-initiative in the project finance sector, and the recently published working paper of the Thun Group of Banks adequately address the U.N. Guiding Principles on Business and Human Rights or do they fall behind the ‘Ruggie framework’? Second, is the demand for human rights due diligence sufficient to classify the EPs as a positive and leverage-based concept of CSR (à la Wettstein and Wood) (...) or is this requirement still a feature of a negative and impact-based concept of CSR? In case it is a negative and impact-based concept of CSR, the question comes up which further steps should be taken by financial institutions to fulfill their positive and leverage-based responsibilities. The article argues that positive and leverage-based responsibilities for multinational companies exist – due to the moral nature of human rights and due to the political authority of multinational companies – and that the current (Ruggie-like) requirements for human rights due diligence are not adequate for a positive and leverage-based concept of CSR. Further measures should be taken by multinational companies – and especially (Equator) banks which possess a high leverage-influence over their clients – to not only ensure the respect for human rights, but also the on-the-ground protection and realization of human rights. Mereological universalists and nihilists disagree on the conditions for composition. In this paper, we show how this debate is a function of one’s chosen semantics for plural quantifiers. Debating mereologists have failed to appreciate this point because of the complexity of the debate and extraneous theoretical commitments. We eliminate this by framing the debate between universalists and nihilists in a formal model where these two theses about composition are contradictory. The examination of the two theories in the model brings clarity (...) to a debate in which opponents frequently talk past one another. With the two views stated precisely, our investigation reveals the dependence of the mereologists’ ontological commitments on the semantics of plural quantifiers. Though we discuss the debate with respect to a simplified and idealized model, the insights provided will make more complex debates on composition more productive and deflationist criticisms of the debate less substantial. Attention to the details of putatively obvious examples of philosophy-as-worldview within Latin America give us reasons to be skeptical about the taxonomy that gives us the category of philosophy-as-worldview. Among the examples that suggest difficulties for this way of thinking about the philosophical enterprise are 19th century Mexican ethnolinguistics, contemporary efforts to reconstruct historical and contemporary Indigenous thought, and 20th century efforts to articulate regional ontologies within Latin America. However, reflection on these cases also point to a different project worth (...) considering, namely, a taxonomy of wisdom- and knowledge-focused practices that might allow a different way of drawing distinctions between kinds of “philosophies”.
